Dusklist — Terms of Use

Version 1, in effect from 3 October 2026.

These terms are an agreement between you and Siva Koza d.o.o. ("we") for the use of the Dusklist app and the website at dusklist.apps.sivakoza.ai. By installing or using either you accept them. If you do not accept them, do not use them.

What Dusklist is

Dusklist lists what a small telescope can show from where you are standing, and helps you point at it. It is free, with no account and nothing to buy.

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, for your own use, as the App Store's usage rules allow.

Accuracy, and what to do with it

Positions are computed on your device using published astronomical methods and are accurate to a few arcminutes for the planets and about a tenth of a degree for the Moon. A constellation is placed at the middle of its figure, and its stick figure is a symbol of the shape, not a chart. That is ample for finding something in a finder, and it is not suitable for navigation, timing, or any purpose where being wrong matters.

The pointing aid is a finder, not an instrument. A phone's compass is typically wrong by about five degrees and can be wrong by thirty near metal, a motor or a speaker. The ring in the middle of the aiming screen is drawn as wide as the error the phone reports, but that figure is itself an estimate. Do not rely on it for anything but locating an object in the sky.

Never point a telescope, binoculars or your eyes at or near the Sun. Doing so causes immediate and permanent blindness. Dusklist computes the Sun's position only to work out when it is dark, and never lists it as a target. Any use of this app near sunrise or sunset is at your own risk, and you are responsible for your own equipment and safety.

Observing often means going out in the dark, sometimes alone, sometimes far from home. Your safety, your transport and your surroundings are your responsibility.

Searches and other websites

"What will it actually look like?" and "How do I spot it?" hand a search to your own browser and search engine. What you find there, and the sites you then visit, are not ours, and their own terms and policies apply. We do not control or endorse them.

Using the website and the support form

Please use the support form to reach us, not to send anything unlawful, abusive, or automated. We may limit or block traffic that looks automated, as the form already does.

Availability

We may change, suspend or discontinue Dusklist or any feature. The app's core — the sky, the list, the pointing aid and the dusk reminder — is computed on your device and keeps working without us.

Liability

Dusklist is provided "as is", without warranties of any kind to the extent the law allows. We are not liable for indirect or consequential loss, for lost data, or for any decision or action taken on the basis of what the app displayed, including damage to equipment or injury arising from observing. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

Where liability cannot be excluded, it is limited to the greater of the amount you paid us in the twelve months before the claim, or EUR 50.

Ending it

You may stop at any time by deleting the app.

Apple

These terms are between you and us, not Apple. We, not Apple, are solely responsible for Dusklist and its content, and for any maintenance and support. Apple has no obligation to provide either.

If Dusklist fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for it; to the maximum extent the law allows, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claim by you or a third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar law. If a third party claims that the app or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.

You confirm that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties. You must comply with any third-party terms that apply when you use the app.

Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.

Law

These terms are governed by the laws of Croatia, and the courts of Croatia have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country you live in, and may bring proceedings there.
